DMCA Policy

1. Overview

Saturday Studios LLC (“us”) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512.

This DMCA Policy describes how copyright owners may submit notifications of claimed infringement and how users may submit counter-notifications regarding material hosted on Sunday Clipboard (the “Service”).

2. Trademark Disclaimer

Sunday Clipboard is an independent application and is not affiliated with, endorsed by, sponsored by, or approved by Electronic Arts Inc. (EA), EA SPORTS, Madden NFL, the National Football League (NFL), NFL Properties LLC, or any NFL club.

All trademarks, service marks, team names, logos, game titles, and other intellectual property remain the property of their respective owners.

References to Madden, EA SPORTS, NFL teams, players, or franchises are used solely for identification and compatibility purposes where applicable. Sunday Clipboard is an independent companion application and is not an official EA SPORTS or NFL product.

3. User Responsibility for Uploaded Content

Users remain responsible for any content they upload. Users may not upload copyrighted content unless they have permission. Users represent that they own or have permission to upload all submitted content.

Sunday Clipboard is a separate companion platform. It does not modify Madden, hack the game, or bypass DRM. Uploading pirated game files, cracked software, or circumvention tools is prohibited.

4. Filing a DMCA Notice of Claimed Infringement

If you are a copyright owner (or authorized to act on behalf of one) and believe that material on the Service infringes your copyright, please send a written notification to our Designated Agent that substantially includes all of the following (as required by 17 U.S.C. § 512(c)(3)):

Required Elements of a DMCA Notice

  1. Physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (for example: URL, franchise/league identifier, filename, upload date, and a description of the content).
  4. Contact information reasonably sufficient to permit us to contact you, such as address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Incomplete notices may delay or prevent processing. We may request clarification.

5. Our Response to Valid Notices

Upon receipt of a substantially compliant DMCA notice, we may:

  1. Remove or disable access to the allegedly infringing material;
  2. Notify the user who posted the material;
  3. Document the notice for compliance and repeat-infringer tracking; and
  4. Take additional action consistent with our Terms of Service, Copyright Policy, and applicable law.

We reserve the right to remove content and/or terminate accounts where appropriate, including in clear cases of infringement even outside the formal DMCA process.

6. Counter-Notification Process

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our Designated Agent pursuant to 17 U.S.C. § 512(g).

Required Elements of a Counter-Notification

Your written counter-notification must substantially include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which Saturday Studios LLC may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

What Happens Next

After receiving a valid counter-notification, we may forward it to the original complainant. Under the DMCA, if the complainant does not notify us within approximately ten (10) to fourteen (14) business days that they have filed an action seeking a court order to restrain the allegedly infringing activity, we may restore the material at our discretion, unless we determine that restoration would create legal or operational risk.

7. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512 and our policies, it is the policy of Saturday Studios LLC to terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

We may consider, among other factors:

  • The number of valid infringement notices;
  • Whether the user submitted bad-faith counter-notices;
  • The severity and willfulness of the infringement;
  • Whether the user uploaded pirated software, game files, or circumvention tools; and
  • Other relevant circumstances.

We may terminate an account after a single serious infringement where warranted.

8. Misrepresentation Liability

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.

Submit notices and counter-notices only if you have a good-faith basis for your claims.

9. Trademark Complaints (Non-DMCA)

The DMCA addresses copyright claims. Trademark complaints (for example, alleged misuse of team marks or branding beyond nominative identification) should be sent to saturdaystudiosllc@gmail.com with:

  • Identification of the mark;
  • Your ownership or authority;
  • Location of the allegedly infringing use; and
  • A description of the requested action.

We will review trademark complaints in good faith under applicable United States trademark law.

10. Relationship to Other Policies

This DMCA Policy should be read with our Copyright Policy, Terms of Service, Content Policy, and Acceptable Use Policy.

11. Changes to This Policy

We may update this DMCA Policy from time to time. The “Last Updated” date will reflect revisions. Continued use of the Service after changes become effective constitutes acceptance, except where applicable law requires otherwise.
